Since 2 January 2021, the Whistleblower Protection Act, also known as the Whistleblower Protection Act, has come into force.
The main objective of this law is to strengthen the protection of whistleblowers and at the same time to uncover and prevent corruption and malpractice within companies.
The implementation of internal whistleblower systems is intended to achieve these goals more effectively.
Duty to transpose
- From 250 employees = 02.07.2023
- From 50 – 249 employees = 17.12.2023
Which contents of the law are compellingly relevant for SMEs?
- It is compulsory for entrepreneurs to set up a reporting office, otherwise they will be in breach of the regulations and face a fine of up to 50,000 euros
- The involvement of the works council is necessary for the establishment of a reporting office in order to check its scope of co-determination
